Terms of use
Terms & Medical Disclaimer
These terms describe the permitted use and important limitations of the Acne Risk Service. They do not waive rights that cannot lawfully be waived.
1. Informational service only
Acne Risk is a self-tracking and educational tool. It is not a doctor, dermatologist, dietitian, emergency service, medical device, laboratory test, or substitute for professional judgment. It does not diagnose, prevent, treat, or cure acne or any condition.
Do not delay or disregard professional care because of a score, association, AI output, research summary, reminder, or other content from the Service. Seek qualified care for medical questions and emergency services for urgent symptoms.
2. Estimates and observational associations
Food estimates and personalized estimates are models, not biological measurements. “Your observed relationship” means an association in logged data and does not prove causation. Results can be affected by missing or inaccurate logs, treatment changes, stress, hormones, sleep, other foods, timing, and chance.
Food-catalog data, barcode matches, nutrition values, voice transcripts, photo interpretations, portions, and AI-generated candidates may be incomplete, outdated, or wrong. Review all entries before relying on or logging them.
3. Account responsibilities
- Provide accurate account information and keep credentials and authenticator codes confidential.
- Use only your own account and do not attempt to access another person’s data or administrative tools.
- Maintain your own exports or backups for anything you cannot afford to lose.
- Do not upload unlawful content, malware, another person’s private health information without authority, or photos you do not have the right to process.
- Do not evade rate limits, AI allowances, paywalls, security controls, or feature restrictions.
4. Acceptable use
You may use the Service for personal, non-commercial tracking. You may not reverse engineer security controls, scrape accounts, probe vulnerabilities without written authorization, interfere with operation, misuse provider services, or use outputs to make medical, employment, insurance, credit, or other high-impact decisions about another person.
5. Optional AI features
AI outputs are probabilistic and may misunderstand speech, images, foods, brands, or amounts. The Service intentionally requires review before logging AI-interpreted foods. You remain responsible for confirming every entry and for decisions made using the output.
6. Paid features
Certain features may require an active entitlement, subscription, or account allowance. Feature descriptions, limits, pricing, renewal terms, and refund rights presented at purchase form part of these terms. Current prototype upgrade requests do not create paid access until payment and activation are confirmed.
7. Availability and changes
We may modify, suspend, limit, or discontinue features to maintain security, comply with law, address provider changes, or improve the Service. We do not promise uninterrupted, error-free, or permanent availability. We will provide notice where required by law.
8. Third-party services and content
The Service relies on third parties such as Supabase, Netlify, OpenAI, Google, Apple, USDA FoodData Central, and Open Food Facts. Their availability, data, and services are outside our control and may be governed by their own terms. Links and research references do not constitute endorsement or a guarantee of accuracy.
9. Intellectual property
The Service’s software, design, branding, and original content are protected by applicable intellectual-property law. You retain rights in content you submit. You grant Acne Risk the limited permission necessary to host, process, display, export, secure, and delete that content to provide the Service under the Privacy Policy.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Acne Risk disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Some jurisdictions do not allow certain disclaimers, so they apply only to the extent legally permitted.
11. Limitation of liability
To the maximum extent permitted by law, Acne Risk and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, personal decisions based on estimates, or harm caused by reliance on inaccurate food, nutrition, AI, or observational outputs.
Nothing in these terms excludes liability that cannot lawfully be excluded, limits statutory consumer rights, or limits responsibility for fraud, willful misconduct, or other non-waivable obligations. Any monetary cap must be determined under the law applicable to the user and the transaction; this document does not invent a cap that may be unenforceable.
12. Indemnity
To the extent permitted by law, you agree to be responsible for claims arising from your unlawful misuse of the Service, infringement of another person’s rights, unauthorized upload of another person’s data, or intentional circumvention of security controls. This does not apply to claims caused by Acne Risk’s own unlawful conduct.
13. Suspension and termination
We may suspend access for material violations, abuse, threats to security, nonpayment, or legal necessity. You may stop using the Service and request deletion through My Profile. Provisions that logically survive termination—including ownership, disclaimers, lawful retention, and dispute-related provisions—will survive.
14. Applicable law and disputes
Applicable consumer-protection and privacy rights remain in force. Before filing a non-urgent dispute, contact the operator through Feedback & requests so the issue can be investigated. These terms do not require arbitration, waive a jury, select a court, or select governing law; those provisions should be added only after the operator obtains jurisdiction-specific legal advice.
15. EEA consumer rights
If you are an EEA consumer, mandatory rights under the law of your country remain unaffected. Nothing in these terms deprives you of protections that cannot be waived by contract, limits your right to contact a consumer-protection or data-protection authority, or requires you to resolve a dispute outside the courts available under mandatory law.
16. Contact and changes
Use Feedback & requests for support and My Profile → Privacy requests for data-rights matters. We may update these terms prospectively and will provide notice where required. Continued use after an effective update may signify acceptance only where applicable law permits; material consent-requiring changes will use an affirmative flow.
